Fraud in the field of personal insurance: discussion questions

The article is devoted to the study of problematic issues of application of article 159.5 of the Criminal code of the Russian Federation in terms of fraud in the field of personal insurance. The relevance of the topic is due to a significant increase in crimes related to insurance fraud, including in the field of life and health insurance. The basic approaches to definition and qualification of the actions forming structure of this crime are stated. On the basis of the system analysis of criminal-legal norms the point of view about possibility of Commission of this type of fraud at the stage of the conclusion of the contract on insurance is disproved.
