Conclusion of cross-border transactions through electronic agents without human participation in this process gives rise to a wide range of issues requiring theoretical understanding. There is no unified approach to the concept and attributes of electronic agents in domestic and foreign doctrine. The author formulates the concept of an electronic agent, concludes that now their existence and functioning is impossible without human participation. The author argues against recognizing electronic agents as independent subjects of law, application of the traditional concept of agency legal relations, extrapolation of the construction of a legal entity to electronic agents. It is concluded that an electronic agent may be endowed only with certain properties of legal personality with the establishment of certain restrictive limits. The author proposes the use of the main and additional conflict of laws clauses to cross-border contracts concluded with the participation of an electronic agent.
