DISPOSAL OF OWNERLESS REAL ESTATE IN MATTERS OF LOCAL IMPORTANCE: FEATURES AND PROBLEMS

In accordance with Federal Law No. 131-FZ dated 06.10.2003 "On the General Principles of the Organization of Local Self-Government in the Russian Federation", one of the issues of local importance of a municipal district is the possession, use and disposal of municipal property. Article 225 of the Civil Code of the Russian Federation refers to the powers of a local government body and measures to identify, account for, and recognize the right of municipal ownership of ownerless immovable property. However, often local authorities are unwilling to carry out the necessary work with the orphan, thereby violating the powers assigned to them in accordance with current legislation. This is facilitated not only by the lack of appropriate financing in the local budgets of municipalities for the maintenance of ownerless real estate objects (for example, hydraulic structures), but also by protracted lawsuits, and the lack of qualified personnel (often, the lack of higher legal education). In this article, we will consider the main problems that arise for local governments in dealing with the institute of mismanagement of special categories of real estate objects: hydraulic structures, ownerless cattle burial grounds, unclaimed land shares of agricultural land, and also formulate ways out of this situation.
